MUNICIPAL ORDINANCE 2501-08
CHANGES TO ALCOHOL AND TOBACCO LICENSES FOR BUSINESSES
- WHEREAS, the City of Los Santos seeks to enhance clarity and improve regulatory oversight of alcohol and tobacco permits; and
WHEREAS, separating the Alcohol-Tobacco Permit into distinct permits for specific activities will streamline compliance and enforcement; and
WHEREAS, the City prioritizes public health, safety, and the needs of businesses;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY MANAGER OF LOS SANTOS AS FOLLOWS:
- SECTION 1. NEW PERMITS
- The current Alcohol-Tobacco Permit will no longer be issued and replaced by the following standalone permits:
1. Alcohol-Serving Permit (ASR): Authorizes the sale of alcoholic beverages in open containers for on-premises consumption.
2. Alcohol - Sale Permit (ASL): Authorizes the sale of alcoholic beverages in sealed containers, prohibiting on-premises consumption.
3. Tobacco Sale Permit (TSP): Authorizes the sale of tobacco products to consumers.
- The fees for the newly established permits are:
Alcohol - Serving Permit (ASR): $40,000
Alcohol - Sale Permit (ASL): $25,000
Tobacco Sale Permit (TSP): $15,000
- 1. Compliance: Permit holders must adhere to all applicable city, state, and federal laws, including age restrictions for alcohol and tobacco sales.
2. Alcohol - Serving Permit: On-premises consumption of alcoholic beverages in open containers must be strictly enforced.
3. Alcohol - Sale Permit: On-premises consumption of sealed alcoholic beverages is prohibited. Clear signage must inform customers of this restriction.
4. Tobacco Sale Permit: Warning signage about the health risks of tobacco must be prominently displayed.
- 1. Non-compliance will result in penalties, including fines, permit suspension, or revocation, as determined by the City Code Enforcement Bureau.
2. Routine inspections will be conducted to ensure adherence to this ordinance.
- This Ordinance shall take effect immediately upon its issuance.
