MUNICIPAL ELECTION CODE

  • WHEREAS, the City of Los Santos recognizes the fundamental importance of democratic elections in ensuring fair representation and governance; and
    WHEREAS, the City seeks to promote transparency, integrity, and public trust in the electoral process; and
    WHEREAS, the City aims to balance the rights of individuals to seek public office and participate in elections with the need to maintain order, fairness, and security in the electoral process;

    NOW, THEREFORE, this Election Code is established to govern the conduct of mayoral elections in the City of Los Santos.
  • Title I — General Provisions
    • Section 1. Purpose and Scope
      This Election Code establishes the legal framework governing the election of the Mayor of Los Santos, ensuring fair, transparent, and democratic processes in accordance with municipal and state law.

      Section 2. Authority
      The provisions of this code are enacted under the authority of the Los Santos Municipal Election Commission, appointed by the Secretary of State, and any applicable state laws governing municipal elections.

      Section 3. Definitions
      (a) "Candidate" refers to any individual who has officially declared their intent to run for the office of Mayor.
      (b) "Election Commission" refers to the municipal body responsible for overseeing the election process.
      (c) "Registered Voter" refers to any individual who meets the eligibility criteria and is duly registered to vote within the City of Los Santos.
    Title II — Election Administration
    • Section 4. Election Commission
      (a) The Secretary of State shall appoint a Municipal Election Commission to oversee the conduct of the mayoral election.
      (b) The Commission shall be responsible for setting election dates, verifying candidates, managing polling stations, and certifying results.
      (c) The Commission shall ensure impartiality and transparency throughout the election process.

      Section 5. Election Schedule
      (a) Mayoral elections shall be held once every four (4) months.
      (b) The Election Commission shall publish an election calendar at least twenty (20) days before the election date, outlining key deadlines for registration, campaigning, and voting.

      Section 6. Voter Eligibility
      (a) To vote in the mayoral election, individuals must be:
      (i) At least eighteen (18) years of age.
      (ii) A legal resident of Los Santos.
    Title III — Candidacy Requirements
    • Section 7. Candidate Eligibility
      (a) Any individual seeking election as Mayor must:
      (i) Be at least twenty-five (25) years of age.
      (ii) Be a legal resident of Los Santos for at least two (2) years prior to the election.
      (iii) Have no felony convictions or pending criminal charges.
      (b) Candidates must submit a formal application to the Election Commission for review and approval at least fourteen (14) days before the election.

      Section 8. Nomination Process
      (a) Candidates are not required to gather signatures.
      (b) The Election Commission shall review applications and approve candidates for the ballot based on eligibility criteria.
    Title IV — Campaign Regulations
    • Section 9. Campaign Conduct
      (a) Candidates shall adhere to ethical campaign practices and refrain from fraud, intimidation, or misinformation.
      (b) Campaigning is prohibited within two hundred (200) feet of polling stations on election day.

      Section 10. Campaign Financing
      (a) Candidates must disclose all campaign donations and expenditures exceeding $5000.
      (b) Anonymous donations over $5000 are prohibited.
    Title V — Voting & Results
    • Section 11. Voting Methods
      (a) Voting shall be conducted via in-person polling stations and authorized digital platforms.
      (b) Early voting is not available.

      Section 12. Vote Counting & Certification
      (a) The Election Commission shall begin counting votes immediately after polls close.
      (b) Election results shall be certified and publicly announced within twenty-four (24) hours of vote tallying completion.

      Section 13. Runoff Elections
      (a) If no candidate receives more than fifty percent (50%) of the vote, a runoff election shall be held between the two candidates with the highest vote totals within seven (7) days.
    Title VI — Disputes & Penalties
    • Section 14. Election Disputes
      (a) Any candidate or registered voter may file an election dispute with the Election Commission within twenty-four (24) hours of result certification.
      (b) The Election Commission shall investigate and issue a ruling within three (3) days.

      Section 15. Penalties for Violations
      (a) Any individual found guilty of election fraud, voter suppression, or campaign finance violations shall be subject to disqualification and legal penalties as determined by the election code.
    Title VII — Electoral Offenses
    • E.C. (5)01. Obstruction of the Electoral Process
      • A person or organization that intentionally puts the integrity and fairness of the electoral process at risk with their actions. Electoral Code (5)01 is a felony punishable by a sentence of 24 hours, with parole eligible after 40 minutes.
      E.C. (5)02. False Advertising
      • A person or organization that intentionally spreads false information about a candidate to the public. Electoral Code (5)02 is a misdemeanor, punishable by a sentence of 8 hours, with parole eligible after 20 minutes.
      E.C. (5)03. Electoral Fraud
      • A candidate who violates the ethical standards as defined in Title IV of the San Andreas Electoral Code or intentionally commits fraud to affect the outcome of the election. Penalties are determined in a case-by-base basis by the Election Committee.
    Title VIII — Final Provisions
    • Section 16. Enforcement
      (a) This Election Code shall be enforced by the Los Santos Police Department and the Los Santos Bureau of Code Enforcement.

      Section 17. Amendments
      (a) Amendments to this Election Code must be approved by a majority vote of the Los Santos Municipal Election Commission.

      Section 18. Effective Date
      (a) This Election Code shall take effect immediately upon adoption by the Election Commission.
