CITY ORDER NO. 2503-08 - LANDLORD AND TENANT REGULATIONS ACT


  • WHEREAS, the City of Los Santos recognizes the importance of fair and transparent rental practices to promote stability and quality of life for all residents; and

    WHEREAS, the City seeks to establish clear guidelines for landlords and tenants to prevent disputes, ensure accountability, and uphold housing standards; and

    WHEREAS, tenant rights and landlord responsibilities must be balanced to encourage a healthy rental market and protect the interests of all parties;

    NOW, THEREFORE, be it ordered by the City Council of Los Santos as follows:

    Purpose: To establish clear guidelines and protections for landlords and tenants within the City of Los Santos, ensuring fair practices, accountability, and quality living conditions. This Order codifies tenant rights and landlord responsibilities, aiming to reduce disputes and improve housing stability.

    SECTION 1 - DEFINITIONS:
    • Landlord – A legal owner of a rental property who collects rent, enforces tenancy agreements, or manages rental operations.
    • Tenant – An individual renting a property from a landlord.
    • Eviction – The legal removal of a tenant from a rental property.
    • Tenancy Agreement – A legally binding contract between landlord and tenant outlining rental terms.
    • Rent – The periodic payment made by a tenant to a landlord for property use.
    • Initial Payment – A one-time payment required to begin tenancy.
    SECTION 2 - LANDLORD REGULATIONS
    • Landlords may establish additional property regulations, provided they comply with this Order. All regulations must be disclosed in writing before the tenant signs a lease.
    • Any amendments to tenancy agreements must be communicated to tenants and may not take effect for at least seven (7) days after notice.
    SECTION 3 - TENANT REGULATIONS
    • Tenants who facilitate a lease transfer to a new occupant must ensure the incoming tenant has access to the landlord’s regulations.
    • If a tenant transfers tenancy for a fee, they are responsible for informing the incoming tenant of all lease conditions.
    • Landlords may impose a percentage fee on lease transfers, provided it is disclosed in writing. Failure to pay the fee constitutes a violation of this Order.
    SECTION 4 - RENT AND INITIAL PAYMENTS
    • Landlords may not require rent payments for periods shorter than seven (7) days, except for the first payment.
    • Tenants must be informed of rent amounts and any required initial payments before signing a lease.
    • Unless otherwise agreed, tenants may leave rent payments in a secure, landlord-approved location.
    SECTION 5 - EVICTIONS AND PROPERTY ACCESS
    • Landlords may only evict tenants for failure to pay rent or other contractual violations.
    • Evictions must comply with anti-discrimination laws and may not be based on race, gender, age, sexual orientation, religion, or disability.
    • Landlords may employ civilian enforcement services for evictions. If a tenant becomes violent or brandishes a weapon, the eviction must be reported to law enforcement immediately.
    Landlords may not conduct unreasonable searches of rental properties. Entry is only permitted for:
    • Repairs and Maintenance
    • Emergency Situations
    • Tenant-Requested Inspections
    • If the reason for entry is non-emergency, the tenant may delay access for up to one (1) hour.
    SECTION 6 - ENFORCEMENT & COMPLIANCE
    • Violations of this Order will be enforced by the Code Enforcement Bureau
    • The City of Los Santos may impose civil penalties for violations.
    • Law enforcement agencies may take action if violations involve criminal conduct.
    Effective Date: This City Order shall take effect seven (7) days after approval by the City Manager.
