MUNICIPAL ELECTION CODE
SAN ANDREAS 2025

  • WHEREAS, the State of San Andreas recognizes the fundamental importance of democratic elections in ensuring fair representation and governance; and
    WHEREAS, the State seeks to promote transparency, integrity, and public trust in the electoral process; and
    WHEREAS, the State aims to balance the rights of individuals to seek public office and participate in elections with the need to maintain order, fairness, and security in the electoral process;

    NOW, THEREFORE, this Election Code is established to govern the conduct of elections in the State of San Andreas.
  • TITLE I. PRELIMINARY PROVISIONS
    This Election Code establishes the legal framework governing the elections in the State of San Andreas , ensuring fair, transparent, and democratic processes in accordance with municipal and state law.
    • E.C. (1)01.
      (a) The San Andreas Municipal Election Committee is recognized as the primary authority presiding over the fair enforcement of the San Andreas Electoral Code. The Committee, chaired by the Secretary of State are put in charge of any investigations into violations of this code and is to oversee the electoral process, they will report their findings directly to the Governor of San Andreas.
      (b) The Commission shall be responsible for setting election dates, verifying candidates, managing polling stations, and certifying results.
      (c) The Commission shall ensure impartiality and transparency throughout the election process.
      • E.C. (1)02.
        (a) This Election Code establishes the legal framework governing the election of the Mayor of Los Santos, and all elections in San Andreas, ensuring fair, transparent, and democratic processes in accordance with municipal and state law.
      • E.C. (1)03.
        (a) The provisions of this code are enacted under the authority of the San Andreas Municipal Election Commission, appointed by the Secretary of State, and any applicable state laws governing municipal elections.
      • E.C. (1)04.
        (a) "Candidate" refers to any individual who has officially declared their intent to run for the office of Mayor.
        (b) "Electoral Commission" refers to the municipal body responsible for overseeing the election process.
        (c) "Registered Voter" refers to any individual who meets the eligibility criteria and is duly registered to vote within the City of Los Santos.
      • E.C. (1)05.
        (a) The Committee members are to submit a declaration under oath as a commitment to tell the truth in the performance of their duties. If the official is later found to have lied whilst bound by the commitment, he/she is charged with Corruption of Public Duty as defined in the Penal Code under (4)16.
      • E.C. (1)06.
        (a) The San Andreas Senate consists of 11 Senators, which are elected at once, once per 4 months. The people of San Andreas get one vote per spot.
      • E.C. (1)07.
        (a) Elections will commence once every 4 months, unless they’re called for by the Secretary of State, on behalf of the Governor. Pre-quarter elections are only called if 4 or more Senators OR the Mayor of Los Santos have been found unfit to fulfil their duty and are removed from office or resigned from their position.

      TITLE II. PROCEDURE AND REGULATIONS
      • E.C. (2)01. Nomination Process
        (a) Candidates are not required to gather signatures.
        (b) The Election Commission shall review applications and approve candidates for the ballot based on eligibility criteria.
      • E.C. (2)02. Candidate Eligibility
        (a) Any individual seeking election as Mayor must:
        (i) Be at least twenty-five (25) years of age.
        (ii) Be a legal resident of Los Santos for at least two (2) years prior to the election.
        (iii) Have no felony convictions or pending criminal charges.
        (b) Candidates must submit a formal application to the Election Commission for review and approval during the application phase.
      • E.C. (2)03. Pre-election phase
        (a) the Secretary of State announces the upcoming elections. Whereas The Election Committee shall publish an election calendar at least twenty (20) days before the election date, outlining key deadlines for registration, campaigning, and voting.
        (b) The supporting documentation for that election is released by the Municipal Election Committee.
        (c) Candidates write their application, which they then forward to the Committee.
        (d) Applications are reviewed by the Committee and processed.
        (e) Candidate list is published by the Committee.
      • E.C. (2)04. Campaigning phase
        (a) The Secretary of State announces the start of the campaigning phase.
        (b) Candidates start their campaign by disclosing their manifesto.
        (c) The highest polling candidates are invited to the closing debate.
      • E.C. (2)05. Voting phase
        (a) The Secretary of State announces the start of the voting phase, calling a halt to the campaigning.
        (b) The people of San Andreas get a total of one week hours to cast their votes.
        (c) After the ballots close, the Committee has forty-eight (48) hours to count and verify the votes casted, after which they disclose the results.
      • E.C. (2)06. Voter Eligibility
        (a) To vote in the mayoral election, individuals must be:
        (i) At least eighteen (18) years of age.
        (ii) A legal resident of Los Santos.
      • E.C. (2)07. Voting Methods
        (a) Voting shall be conducted via in-person polling stations and authorized digital platforms.
        (b) Early voting is not available.
      • E.C. (2)08. Vote Counting & Certification
        (a) The Election Commission shall begin counting votes immediately after polls close.
        (b) Election results shall be certified and publicly announced within twenty-four (24) hours of vote tallying completion.
      • E.C. (2)09. Runoff Elections
        (a) If no candidate has the lead of the vote after the voting period, a runoff election shall be held between the two candidates with the highest vote totals within seven (7) days, if there is only two candidates, the voting period shall be extended for twenty-four (24) hours.

      TITLE III. CAMPAIGN REGULATIONS, CONDUCT, AND ETHICS
      • E.C. (3)01. Campaign Conduct
        (a) Candidates shall adhere to ethical campaign practices and refrain from fraud, intimidation, or misinformation.
        (b) Campaigning is prohibited during the voting period.
      • E.C. (3)02. Campaign Finances
        (a) Every candidate which submits their application, is to raise $100.000 as a deposit payment to the Electoral Bureau.
        (b) Candidates are only allowed to receive limited, one time amounts from the following parties:
        (i) Registered political party ($100.000).
        (ii) Private citizen of San Andreas ($25.000).
        (iii) Businesses, Unions or other special interest groups ($50.000).
        (c) Candidates are to keep records of the received donations; these records are to be accessible by the Electoral Bureau at all times.
        (d) Failing to keep, tampering with or fraudulently keeping the aforementioned records will be punished with charges of Fraud (2)16 as defined in the Penal Code.

      • E.C. (3)03. Campaign Ethics
        (a) Candidates and their staff are to maintain the highest standards possible, as they serve an exemplary function.
        (b) Candidates are expected to have no felonies or recent misdemeanors on record. Case by case exceptions may be made at the Secretary of State’s discretion.
        (c) Candidates are to show no disrespect to one another during the entire electoral process, this includes but is not limited to: advertisements, interviews, manifestos etc.

      TITLE IV. DISPUTES AND PENALTIES
      • E.C. (4)01. Election Disputes
        Election disputes are inherent to elections. Challenging an election, its conduct or its results, should however not be perceived as a reflection of weakness in the system, but as proof of the strength, vitality, and openness of the political system.
        (a) Any candidate or registered voter may file an election dispute with the Election Commission within twenty-four (24) hours of result certification.
        (b) The Election Commission shall investigate and issue a ruling within three (3) days.
        (c) Decisions made by the Electoral Committee are final and cannot be appealed.
      • E.C (4)02. Penalties for Violations
        (a) Any individual found guilty of election fraud, voter suppression, or campaign finance violations shall be subject to disqualification and legal penalties as determined by the election code.
      TITLE V. Electoral Offenses
      • E.C. (5)01. Obstruction of the Electoral Process
        A person or organization that intentionally puts the integrity and fairness of the electoral process at risk with their actions. Electoral Code (5)01 is a felony punishable by a sentence of 24 hours, with parole eligible after 40 minutes.
      • E.C. (5)02.False Advertising
        A person or organization that intentionally spreads false information about a candidate to the public. Electoral Code (5)02 is a misdemeanour, punishable by a sentence of 8 hours, with parole eligible after 20 minutes.
      • E.C. (5)03. Electoral Fraud
        A candidate who violates the standards as defined in Title III of the San Andreas Electoral Code or intentionally commits fraud to affect the outcome of the election. Penalties are determined in a case-by-base basis by the Election Committee
      • E.C. (5)04. Political fraud
        A candidate who knowingly alters, creates, or uses a written document with the intent to affect the electoral process, is guilty of a felony, punishable by a sentence of 12 hours, with parole eligible after 120 minutes.

      TITLE VI. ORGANIZATIONS
      • E.C. (6)01. Political parties
        (a) Political parties recognized by the Electoral Bureau are listed in addendum I of the San Andreas Electoral Code. Only those listed are to be represented during the elections, every other candidate is considered to be independent.
        (b) For a party to be recognized they must file for declaration of recognition, this is only granted to the parties that upkeep the highest standards of ethics and professionalism. Requirements:
        (i) $250,000/year registration fee, which is to be raised during a public fundraiser.
        (ii) At least 5 active members.
        (iii) A party headquarters in a respectable area of urban or rural San Andreas.
      • E.C. (6)02. Public agencies
        (a) Public agencies are prohibited from endorsing a candidate either internally or externally. This includes: appearing during campaigning events, wearing campaign material, making campaign donations and advocating for the candidate.
      Title VII. FINAL PROVISIONS
      • E.C. (7)01. Enforcement
        (a) This Election Code shall be enforced by the Los Santos Code Enforcement Bureau and the Los Santos Police Department
      • E.C. (7)02. Amendments
        (a) Amendments to this Election Code must be approved by the Secretary of State.
      • E.C. (7)03.Effective Date
        (a) This Election Code shall take effect immediately upon adoption by the Election Commission.
