SECTION I. DEFINITIONS
This policy document uses or implies language that may be considered ambiguous. The definitions for such language is as follows:
- Detective is defined as an on duty or undercover member of a department's investigative division or its uniformed support division
- Gang unit is defined as the division of a law enforcement agency or an on duty member of the division of a law enforcement agency whose primary objective is the suppression, investigation or prosecution of gangs and gang members
- Major crimes unit is defined as the division of a law enforcement agency or an on duty member of the division of a law enforcement agency whose primary objective is the suppression, investigation or prosecution of organized crime groups, financial crime, and crimes against the state
- Street crimes unit is defined as the division of a law enforcement agency or an on duty member of the division of a law enforcement agency whose primary objective is the suppression, investigation or prosecution of crimes against the person that do not fall within the scope of a gang unit or major crimes unit
- Gang is defined as a loosely organized group of people that are identifiable by uniform attributes, such as clothing, tattoos, patches, or greeting gestures ("gang signs")
- Organized crime group (OCG) is defined as an organized group of people that are not identifiable by uniform attributes, such as clothing, tattoos, patches, or greeting gestures ("gang signs"), that primarily commit financial crimes or crimes against the state
- Primary agency is defined as the department with primary law enforcement authority over a given jurisdiction
- Secondary agency is defined as the department with secondary law enforcement authority over a given jurisdiction
- Plain-clothes unit is defined as an investigative officer or group of investigative officers under a shared callsign operating as on duty peace officers as defined by the Commission on Peace Officer Standards and Training, but without displaying attributes that make them readily identifiable as a police officer.
- Undercover officer is defined as a peace officer that carries no police equipment and displays no attributes that identify them as a police officer, and do not readily have access to police equipment.
SECTION II. INTELLIGENCE SHARING AGREEMENTS
The Los Santos Police Department (LSPD) and Los Santos County Sheriff's Department (LSSD) hereby agree to the following intelligence sharing policies:
- The LSPD and LSSD are required to share relevant, case-specific intelligence between their gang units if requested by their partner agency. The requesting agency decides what is and is not relevant.
- The LSPD and LSSD are required to share relevant, case-specific intelligence between their major crimes units if requested by their partner agency. The requesting agency decides what is and is not relevant.
- The LSPD and LSSD are required to share relevant, case-specific intelligence between their street crimes units if requested by their partner agency. The requesting agency decides what is and is not relevant.
SECTION III. OPERATIONAL AGREEMENTS
The Los Santos Police Department (LSPD) and Los Santos County Sheriff's Department (LSSD) hereby agree to the following operational policies:
- Detectives of any designation may engage in active law enforcement patrols in either their primary or secondary jurisdictions at will and without limit, with no maximum number of occupants per unit
- Gang detectives may not initiate, continue and conclude their own investigations in their primary or secondary jurisdictions at will and without limit, and must contact their partner agency before beginning gang investigations or concluding them in their secondary jurisdiction
- Gang units may engage in active gang enforcement operations in either their primary or secondary jurisdictions at will and without limit
- The primary agency may request that secondary agency gang units leave an area in their primary jurisdiction for up to four (4) hours without requiring good reason. Longer than this time limit requires good reason.
- The secondary agency must notify the primary agency's relevant gang unit authority when conducting investigative operations that involve five (5) or more gang detectives
- Major crimes or street crimes detectives may initiate, continue and conclude their own investigations in their primary or secondary jurisdictions at will and without limit
- Plain-clothes units may patrol in their primary and secondary jurisdiction at will and without limit, with a maximum of four (4) occupants per unit
- Undercover vehicles may only be used as part of an on-going investigation and must be used for a specific task in both an agency's primary and secondary jurisdiction
- Undercover units or detectives in undercover vehicles may respond to situations if exigent circumstances apply, and no other unit is available to respond.
- Undercover vehicles may not have access to emergency lighting or other police equipment, including self defense equipment and radio receivers
