SPECIAL PROVISIONS FOR SUBSIDIES

  • Section 1: Eligibility for Subsidies
    1.1 Eligible Projects:

    Subsidies under the City of Los Santos Public Works Construction Code are available for projects that align with the following categories:
    • Public Infrastructure Development: Roads, bridges, utilities, and other essential public services.
    • Environmental Protection and Sustainability: Projects that contribute to environmental preservation, renewable energy, or green infrastructure.
    • Affordable Housing and Community Development: Residential or commercial construction aimed at benefiting low- to moderate-income communities.
    • Disaster Resilience: Projects that enhance disaster preparedness or recovery infrastructure.
    1.2 Applicant Eligibility:

    Subsidies may be requested by:
    • Private Businesses
    • Non-Profit Organizations
    • Public Entities
    • Joint Public-Private Partnerships
    • Individuals for specific public works projects, subject to additional review.
    1.3 Minimum Project Size:

    Projects with a total cost of $100,000 or greater are eligible for consideration. Projects below this threshold may be considered on a case-by-case basis, particularly if they meet specific public policy goals, such as environmental sustainability or affordable housing.
  • Section 2: Types of Subsidies Available
    2.1 Direct Financial Assistance:
    • Eligible applicants can request direct financial subsidies to cover up to 60% of eligible project costs. These may include construction materials, labor, permits, environmental compliance, and other necessary project expenses.
    2.2 Permit Fee Waivers:
    • Eligible projects, especially those focusing on sustainability, green building, or public infrastructure improvements, may receive partial or full waivers of construction permit fees.
  • Section 3: Conditions for Receiving Subsidies
    3.1 Environmental Compliance:
    • All projects receiving subsidies must comply with environmental regulations as outlined in the Public Works Construction Code. Projects in Environmentally Sensitive Areas (ESAs) must demonstrate a clear commitment to environmental protection.
    3.2 Job Creation:
    • For commercial or industrial projects, applicants must demonstrate that the project will contribute to local job creation or workforce development, with priority given to projects that create permanent employment opportunities.
    3.3 Use of Local Labor:
    • Subsidized projects are encouraged to utilize local labor and resources. Preference will be given to those that prioritize local contractors, suppliers, and workforce development.
    3.4 Public Benefit Requirement:
    • Subsidized projects must clearly demonstrate a public benefit, such as improved infrastructure, enhanced public services, or environmental protection. Projects must contribute to community development or public welfare.
  • Section 4: Repayment and Recapture Provisions
    4.1 Failure to Complete Project:
    • If a project receiving a subsidy fails to be completed or ceases operation after receiving funds, the applicant will be required to repay the subsidy in full, unless an exemption is granted by the Department of Public Works based on mitigating circumstances.
    4.2 Non-Compliance:
    • Subsidy recipients who are found to be non-compliant with the Public Works Construction Code, environmental laws, or the terms of their subsidy agreement are liable to repay all or part of the financial assistance, in addition to penalties.
    4.3 Inspection and Reporting Requirements:
    • Subsidy recipients are subject to regular inspections and must show cooperation during them, refusal may result in permit suspension and recapture of funds.
  • Section 6: Dispute Resolution and Appeals
    6.1 Appeals Process:
    • Applicants whose subsidy requests are denied may submit an appeal to the City Manager's Office within 10 days of receiving notice of denial. City Manager will review the case and provide a decision within 10 days of receiving the appeal.
