TZOMPAXTLE, RABINOWITZ, AND BARBIERI LIMITED LIABILITY PARTNERSHIP is exempt from the requirement of inspection on multiple grounds.

First, we are a law firm that engages in sensitive business with our clients. Our staff regularly discusses client cases and sensitive materials may be visible on desks, computer screens, or whiteboards that an inspecting individual may see. If we were to permit an inspector to see such materials, we would be violating the fundamental attorney-client privilege that is ethically required of us. It is also not feasible to cease all client work during the inspection as we are a busy law firm with many clients who need to be cared for under the terms of our agreements with them. Our work simply does not stop for any reasonable amount of time that would permit an inspection free of the risk of sensitive materials being seen.

Second, the building in which we are located is owned by Mr. William Anderson and has already been duly inspected by the City of Los Santos. It has been given a Certificate of Occupancy for both its main concourse and all offices and apartments contained within it. Therefore, since our business operates from a building that has already passed the fire code, there is no need to inspect for fire code reasons. Further, since there is no other reason to inspect other than assurance of fire code compliance, there is no reason to inspect the premises at all.

Once again, our firm is willing to pursue all legal remedies to enforce our rights.

Mr. Spencer,

We are contacting you to schedule a meeting in regard to our recent application for registration of our law firm as a tax exempt organization under the established policies and procedures of this government.

We submitted our application on May 16th, 2025, and it was moved into the Inspection phase on May 19th, 2025, by Mr. Declan Kinehan. Shortly after, we submitted a letter describing our specific reasoning for an inspection not being necessary or proper. We then received a letter from Mr. Kinehan once more that appeared to reverse his original decision to move us into the Inspection phase as he demanded medical proof of my disability and proof that the structure was not modified any further since the original issuance of the Certificate of Occupancy. After receiving this egregious response from Mr. Kinehan, we immediately requested our application be placed on a pending status until the matter could be reconciled with your office. We seek a meeting in person with yourself and Mr. Kinehan as a means of mediating this dispute equitably and efficiently.

Firstly, under the policies of this city, businesses owned by a person with disabilities are tax-exempt. I have duly asserted by rights as a person with a disability. Under the Americans with Disabilities Act, government agencies may not create qualifying criteria for a person with disabilities to receive services. The only permissible requirement is that a person have a disability. Furthermore, there is no law that permits Mr. Kinehan to demand that I receive a medical examination at my own expense in order to prove my disability to him. For Mr. Kinehan to impose additional requirements or regulations beyond those that are enforced upon others is for him to impose an arbitrary standard. It is unconstitutional for a government agency to impose arbitrary requirements upon applicants for services, as explained by the District of Columbia circuit in Sherill v. Knight, 569 F.2d 124 (D.C. Cir. 1977).

Secondly, we have asserted that our firm's offices house sensitive information such as client records. Information may be displayed on whiteboards, cork boards, and company computers that could potentially compromise our clients' privacy and therefore violate attorney-client privilege. Furthermore, our office is located in an apartment complex that has already received a Certificate of Occupancy prior to any persons being permitted to live in it or set up an office within it. We purchased a unit from the complex owner in an unmodified state and have not made any structural modifications to it. Mr. Kinehan, however, is requiring that we hire, at our own expense, a construction or maintenance company to verify that no changes have been made. However, he is also very capable of consulting the blueprints filed with the assessor's office – our property has not undergone any changes significant enough to warrant a tax assessor's evaluation of our property for property tax purposes. Furthermore, as we previously explained, it is unconstitutional for Mr. Kinehan to impose additional requirements or regulations beyond those that are enforced upon others as this imposes an arbitrary standard.

Throughout this exchange, we have asserted multiple times that we are willing to pursue all legal remedies up to and including a civil lawsuit in order to vindicate our rights. However, we prefer this not be the direction we take - we prefer instead for your office to issue legal guidance to Mr. Kinehan and instruct him to issue our business registration certification as a tax exempt Professional Services organization.

If Mr. Kinehan or his office place our application in a status of denied/rejected, we will begin pursuing all legal remedies by naming the City of Los Santos and Mr. Kinehan himself as a defendant both personally and officially in a civil lawsuit seeking compensatory damages for this exhausting regulatory process as well as punitive damages for the egregious imposition of arbitrary standards upon us for no apparent reason. If we are forced to do this, we will also use our contacts in the media to publicly call for the resignation of Mr. Kinehan.

If we do not receive a reply from your office within 48 hours, we will assume you are unwilling to resolve this matter.
